If you’ve been stopped for drinking and driving, it can be an embarrassing situation. However, if you’ve had only one drink and you think that you’re ok, there’s no need to stress out. There have been cases, though, in which a person was pulled over by the police and was arrested even though they weren’t over the legal limit for drinking. So, there are a few things you should know so you’re not wrongfully accused of a DUI…

* If you fail a field sobriety test, it not necessarily evidence of your intoxication. These field tests only measure your physical aptitude. There’s a chance that people who have a medical or physical disability can fail these field tests.

* The best way to find out if you’re over the legal drinking limit is to request to have a blood test (or chemical testing). You have the right to take a blood test or to have your own doctor conduct the test.

* You could submit to a breath analysis test, but keep in mind that this is a controversial method of determining someone’s level of intoxication. Sometimes these breath machines are not maintained properly which could produce a false reading. In addition, there are other factors involved that could affect the results of a breath test like the types of medication you take, your food diet, or even your occupation. Keep in mind that it is your right to refuse the breath analysis test and ask for a blood test instead.

It’s important to have an accurate of your blood alcohol level so that you aren’t falsely accused of drunk driving. Also keep in mind that you have rights and can exercise them when you’re pulled over by law enforcement.
